Police: 3 Illinois gang members charged in Wisconsin killing

Three members of an Illinois street gang are accused in the fatal shooting of a fellow gang member at a Wisconsin home last month, police said Thursday.

Eau Claire Police Chief Matt Rokus said that the victim, James Garcia-Smith, 29, of Eau Claire, had ties to Chicago and was selling large quantities of marijuana at the time he was killed.

Two suspects, Juan Olivarez, 23, and Joe Moya, 27, both of Chicago, were arrested Wednesday and are being held in the Cook County Jail pending extradition to Wisconsin. A warrant has been issued for the third suspect, Ian Kearns, 22, of Sandwich, Illinois, who remained at large.

All three men are charged with a felony count of first-degree intentional homicide as a party to a crime.

The police chief said there could be more arrests, the Leader-Telegram reported.

Garcia-Smith was found fatally shot at an apartment in Eau Claire on March 20. A 32-year-old woman also was shot in the leg but survived. Three children in the home were not physically hurt.

The woman told investigators two men kicked in the door, confronted Garcia-Smith and pointed a gun at him. The woman said she wrestled one of the intruders to the ground and held him in a headlock when she heard shots and realized that both she and Garcia-Smith were shot.
